Services are provided on a “best-efforts” basis, subject to these Terms and applicable laws. Specific terms for each service will be detailed in your service agreement or proposal.
User Responsibilities

- You are responsible for maintaining the confidentiality of your account login details and all personal financial information.
- You must use our services in compliance with all applicable laws and regulations in India, including but not limited to those related to financial services.
- You acknowledge that the ultimate financial consulting and investment decisions, and their consequences, are your sole responsibility.
- You are responsible for ensuring the correctness and authenticity of all documents and information you provide to us.
- You understand that financial markets are dynamic and acknowledge the need to cross-verify information and consult with other qualified professionals before acting on any information received through our services.
Investment Risks and Disclaimer
- All investments, including fixed deposits and mutual funds, are subject to risks, including market risks. Past performance is not a guarantee of future returns. Please read all scheme-related documents carefully before making any investment.
- Our guidance and consulting are based on our analysis of available information and the data you provide. However, we do not guarantee any specific outcome, profit, or prevention of financial or opportunity losses.

Insurance Services and Disclosures

- You acknowledge that any insurance-related information we provide is subject to change based on the respective insurance companies’ policy updates.
- We are bound to follow all rules and regulations set by the insurance companies we represent and the IRDAI.
- Disclosure: We receive commissions from the insurance companies for policies purchased through our facilitation.
Limitation of Liability
- To the maximum extent permitted by law, MYFINPLAN, its affiliates, and its representatives shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of profits, data, or business interruption, arising from your use of or inability to use our services.
- Our maximum aggregate liability for any direct damages arising from your use of our services shall be limited to the amount paid by you for the specific service directly giving rise to such liability.
- We are not liable for any losses incurred due to the failure, downtime, or malfunction of third-party services, including but not limited to investment platforms, payment gateways, or insurance company portals.
- We are not liable for any losses or adverse outcomes incurred due to incomplete, inaccurate, or incorrect information provided by you.

Governing Law and Dispute Resolution

- If the dispute cannot be resolved through negotiations within 30 days, the parties agree to submit the dispute to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended) for the time being in force. The place of arbitration shall be Bangalore, India.
- Notwithstanding the above, either party may seek injunctive or other equitable relief from the courts in Bangalore, India, to prevent actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
KYC Compliance
- You agree to provide all necessary Know Your Customer (KYC) documentation and information as required by applicable laws, regulations, and our internal policies for the provision of services.
- You acknowledge that we may utilize external services, such as CAMS KRA, to verify your KYC status and other relevant information.
- Your failure to provide complete and accurate KYC documentation may result in the suspension or termination of your access to certain services.
Force Majeure
- MYFINPLAN shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including, without limitation, acts of God, war, acts of terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
Severability
- If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Waiver
- No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and MYFINPLAN’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
Entire Agreement
- These Terms, together with any service agreement or proposal executed between you and MYFINPLAN, and our Privacy Policy, constitute the entire agreement between you and MYFINPLAN concerning the use of the website and services and supersede all prior or contemporaneous communications, understandings, and agreements, whether oral or written.
